​Uncontested Docket Hearing Requests - Probate, Heirships, and Guardianships

REQUIREMENTS FOR ALL PROBATE OF WILL DOCKETS: 

PRIOR TO SETTING A HEARING - 

  • ALL unsigned, proposed hearing documents must be e-filed for the Court’s review prior to setting a hearing.  This includes, but is not limited to, documents such as:  proposed proofs of death, proposed witness affidavits/testimony, proposed orders and proposed oaths;

  • The original will (or physical copy of the purported will, in the case of a will not produced in Court - NPC) must be delivered to the Probate Clerk and on file; and

  • All required citations must be issued.


Probate of Will Docket (Independent/Dependent Administrations)

UNCONTESTED PROBATE OF WILL DOCKETS HELD ON TUESDAYS

(Rocket Docket) @ 9:30 A.M

(Regular Dockets) @10:00 A.M. and 1:00 PM.

Requirements to be set on the "Rocket Docket":

  • Self-Proved, Original Will;
  • Attorney is the only necessary witness to prove up the Will; and
  • E-Filed proposed hearing documents (Proof of Death must reflect the attorney's name as Affiant).

REQUIREMENTS FOR HEIRSHIP DOCKET: 

PRIOR TO SETTING A HEARING - 

  • ALL unsigned, proposed hearing documents must be e-filed for the Court’s review prior to setting a hearing.  This includes, but is not limited to, documents such as:  proposed proofs of death, proposed witness affidavits/testimony, proposed orders and proposed oaths;

  • All required citations must be issued and returned;

  • An Attorney Ad Litem (AAL) must be appointed and the AAL's answer filed;

  • The Affidavit of Service of Citation (TEC 202.057) filed; and

  • Proposed Order/Judgment Declaring Heirship SIGNED by the Attorney of Record AND the Attorney Ad Litem.

Heirship Docket (and Accompanying Administrations):

Wednesdays @ 1:00 PM and 3:00 PM
